SEC files to dismiss fraud lawsuit against SolarWinds
The Securities and Exchange Commission filed a motion along with SolarWinds and its chief information security officer to dismiss the SEC's civil fraud lawsuit against the software company. The lawsuit accuses SolarWinds of being aware of and not disclosing security vulnerabilities ahead of a major cyberattack. A federal judge threw out a majority of the claims in the case last year.

SEC enforcement actions drop 30% amid leadership change
The Securities and Exchange Commission brought 30% fewer enforcement actions against public companies in fiscal 2025 compared with fiscal 2024, according to a report from the NYU Pollack Center for Law & Business and Cornerstone Research. The report highlights that the drop coincided with the transition from former SEC Chair Gary Gensler, who oversaw the majority of fiscal 2025 actions, to new leadership under current Chair Paul Atkins. Experts note that while such declines are common during periods of administrative change, the number of enforcement actions following Atkins' appointment is the lowest recorded for incoming chairs since at least fiscal 2013.

FCC overturns telecom security rule, cites overreach
The FCC voted to reverse a rule enacted under the Biden administration that required telecommunications firms to strengthen safeguards on systems managing law enforcement wiretap requests, with proponents arguing that the rule exceeded the agency's authority. Democratic Commissioner Anna Gomez dissented, saying the rollback lets carriers escape responsibility for the security gaps that enabled the attacks.

Judge rules against Trump admin's Guard deployment in D.C.

US District Judge Jia Cobb held that the Trump administration must end its deployment of National Guard troops in the District of Columbia. Cobb stayed her order for 21 days to provide an opportunity for the administration to appeal. She wrote that the deployment is "unlawful" and has resulted in "irreparable harm to [D.C.'s] sovereign powers under the Home Rule Act."

DOJ now says entire grand jury reviewed Comey indictment
The Justice Department said in a Thursday court filing that the full grand jury reviewed the final indictment of former FBI Director James Comey before it was sent to a federal judge in late September. Previously, acting US Attorney for the Eastern District of Virginia Lindsey Halligan testified that the final indictment was not reviewed by the entire grand jury, and Assistant US Attorney Tyler Lemons said during a hearing that the full grand jury did not review it. Comey has pleaded not guilty to charges of making a false statement to Congress and obstructing a congressional proceeding.

CFPB reportedly to move enforcement cases to Justice Dept.
The Consumer Financial Protection Bureau is looking to shift its remaining enforcement cases and litigation to the Justice Department and furlough the agency's in-house enforcement attorneys, a move that would affect over 100 CFPB employees, sources said. The moves come after acting Director Russell Vought said the CFPB's funding is sufficient only to cover its operations through the end of 2025. Meanwhile, a preliminary injunction bars the CFPB from conducting mass firings via a reduction in force.
