This afternoon, I joined Allison Gill of The Breakdown Substack (and Mueller She Wrote and Daily Beans podcasts) to discuss the nitty-gritty of the new DHS memo purporting to authorize ICE agents to enter people’s homes without a search warrant. We discussed the Fourth Amendment rationale for requiring a warrant, signed by a neutral magistrate.
ICE has been quiet about this new rule in the wake of the disclosure of the memo, but it’s something we all need to be aware of. As things stand, they could use this procedure anywhere, not just in Minnesota and Maine, where the cameras are focused, but in other places where there might be less attention at the moment.
