With the publication of the Interim Final Rule (IFR) 2026-12669 Federal Register :: Indefinite Suspension of the De Minimis Exemption for Mail Shipments and New Postal Informal Entry Process by U.S. Customs and Border Protection (CBP), requiring mail shipments to file Entry Type 13 upon or prior to arrival in the United States, CPSC will require eFiled certificates for mail shipments, via a Full or Reference Message Set, beginning on October 22, 2026.
Previously, CBP did not collect entry data for products imported into the United States via international mail; thus, those shipments could not transmit the PGA Message Set required for products regulated by CPSC. With the new Entry Type 13 being required by CBP (Federal Register :: Test of the New Electronic Informal Entry Process for Mail), mail shipments will be required by CPSC to transmit either a Full or Reference Message Set via the Automated Commercial Environment (ACE).
The importer is responsible for eFiling a certificate whenever one is required. The importer definition in CPSC’s Certificates of Compliance Final Rule (Federal Register :: Certificates of Compliance) specifies that for imported finished products, the importer, for purposes of CPSC’s certificate requirement, is a party eligible to make entry for the merchandise pursuant to CBP statutes and regulations, who may be an owner, purchaser, consignee, or authorized customs broker.
