The U.S. Consumer Product Safety Commission (CPSC) recently publis updated guidance providing additional information on the Harmonized Tariff Schedule (HTS) codes that have been flagged in CBP's Automated Commercial Environment (ACE) since July 8, 2026.
The updated guidance document contains the approximately 600 HTS codes that CPSC believes are likely to include products that are subject to a mandatory standard or are otherwise deemed to be high risk. However, the list is now organized by the specific flag—CP1 or CP2—assigned to each HTS code by CPSC. This new format is intended to assist the trade community by clearly indicating when data may be required and when it is required for a shipment, based on the associated HTS code.
In addition to the updated format, a small number of HTS codes had their associated flags changed or removed. The details of those modifications are available in the document's "Change Log" tab.
It is important to note that the list does not encompass all HTS codes that may contain a product requiring an electronic certificate of compliance. As a reminder, when an eFiled certificate is required, the responsibility for submission rests with the importer.
